“Towards a digital jurisdiction” discussion at the Marques Annual Conference. Brands and institutions need to adapt to meet the changing expectations of consumers.

Our Associate Partner Miguel Angel Medina, a MARQUES Council Member, chaired a session analysing the moves towards a digital jurisdiction. On the panel, our Partner Javier Fernández-Lasquetty talked about how the growing digitization of the economy has led to a gap between the “digital” problems suffered by IP right holders and the response provided by the courts.

He described developments in this field and how, in practice, digital platforms have offered a quick and inexpensive but imperfect solution. Therefore, he proposed the creation of a supranational system that right holders could access to resolve disputes and that the decisions adopted should be enforceable throughout the “digital territory”.

Leandro Toscano, Head of the Business Development Unit at WIPO’s Arbitration and Mediation Center in Switzerland, and Ricardo Pérez from Kantar, also participated in the interesting discussion.
